摘要
随着依法治国进程的推进,人权保障显得越来越重要。法治社会背景下,资源密集型地区的外地矿工权益保障还相对不足,以致在一定程度上出现了"同命不同价"的现象。该现象的出现与矿工的组织化程度、公权力价值本位的取向、本地村民与外地矿工的互动关系等因素有关。为更好地保障外地矿工的基本人权,建设和谐法治社会,今后要从强化法律实施、加强制度建设、探索建立内外联动机制三个方面来进一步完善外地矿工生命权保障机制。
With the advancement of the rule of law, protecting human rights is more and more important. Howev- er, in the society with the rule of law, the foreign miners＇ rights and interests in the resource-intensive area are not protected sufficiently, so the phenomenon of ＂life with different prices＂, to a certain extent, appear. Why the phenomenon emerge？ It relates to this factors： the miners＂ organizational degree, the value standard of public power, the local villagers and foreign miners＇ interactive relationship, etc. In order to better protect the basic rights of this foreign miners, build a harmonious society ruled by law, we need to strengthen to enforce the laws, strengthen to construct the system, and explore a internal and external link- age mechanism so that we can further improve the foreign miners＇ life right safeguard mechanism.
