摘要
法律工具论的思想长久以来对中国法的发展产生了深远的影响。这种思想的形成及发展有其政治体制方面的原因。从西方不同时期政体与法的发展的关联性及东西方法的差异的比较中可以总结出:政治体制的差异会影响到执政者对法的认识的差异,而此种差异又会对一个国家的法律文化产生深远影响,继而对一国法理学及法的总体发展产生不同影响。在提倡法治的当代中国,对此种差异的历史及影响的认识有助于寻求提高全民法治意识的方法。
The law instrumentalism has far- reaching influence on the development of legal theory in China. It＇s formation and the development has some relationship with the regime. Through studying the relationship in the West between the regime and the development of legal theory and comparing the differences of the East and the West in legal theory development, it can be summarized that the differences of regime can lead the differences of rulers＇ law understanding, and this kind of differences can have the profound influence to a national legal culture, subsequently have the influence to a national legal theory and the overall development of law construction. Therefore the study on the history and the effect of the differences can do some good to enhance the legal consciousness.
