摘要
对在中国已有近五十年历史的劳动教养制度进行改革是现实的需要,而为其寻找到立足点是立法化的前提。从现行法律制裁体系、劳动教养的对象入手分析,劳动教养制度有其存在的合理性,而保安处分化是其理想的出路。
It is necessary to reform the fifty - year labor education and rehabilitation system in China, however, to find the stand is the precondition for lawmaking. Analysing from the current legal sanction system and the objects of the labor education and rehabilitation system, we find that there are some rationality in the labor education and reha- bilitation system and security measures is the perfect way.
