摘要
目前,我国行政强制立法正在紧张的制定之中,行政强制执行权分配模式成了行政法学理论界的一个热点问题。中国现行强制执行权分配模式由于其历史局限性已远远不能适应行政法治实践的需要。因此,重新认识行政强制执行权的性质,科学合理地设计中国的行政强制执行权分配模式对于促进中国的行政强制立法具有重要的促进意义。
At present, the administrative compulsory legislation is being intensely made. The distribution mode of administrative compulsory enforcing jurisdiction has become a theoretically heated point in the administrative jurisprudence circle. The current distribution mode of compulsory jurisdiction in China has not been able to meet the demand of administrative legal practice. Therefore, it is of great significance in promoting administrative compulsory legislation to re - recognize the nature of administrative compulsory jurisdiction and design scientifically its distribution mode.
