摘要
惩罚性赔偿是英美法系创造的制度,具有独特的惩罚和遏制功能。它是一项被实践证明了的成熟的、行之有效的制度,尽管它确实并非完美,但是该制度的独特功能非常适应当前我国社会发展的需要;本文重点分析了在我国民法典中完整确立惩罚性赔偿制度的必要性,并就其适用提出了一些可行性建议。
Chastening compensation, which is created in American and British law system, is a system with a special function of punishment and containment. It is a mature and effective system that has been proved by practice. Although it is not perfect, the special function of this system meets the demand of our social development very much. The author of the present thesis lays stress on the establishment of a complete chastening compensation system in our civil code. Meanwhile, the author puts forward some feasible suggestions for the application of the system.
