摘要
对于饱受争议的惩罚性赔偿机制来说,法律适用问题的解决意义或许更加重大。毕竟,惩罚性赔偿制度是一把双刃剑,如何规范其适用,以发挥最大效用并减少副作用是一个现实的问题。对惩罚性赔偿的适用应贯彻适用范围法定原则、适用标准法定原则和赔偿数额法定原则。
As to the punishing compensation system of full of debates, the settlement of legal application is of great significance. For punishing compensation is a double-blade sword, how to use it and make it perform the highest efficiency with little side--effect is a realistic problem. The application of punishing compensation should obey these legal rules of application fields, application standard and compensation volume.
