摘要
信息产权理论是对社会实践的回应,是对现有知识产权理论的扩展。将信息产权理论应用于数据库的法律保护,是未来数据库法律保护的发展方向。我国应该建立符合我国国情的数据库专门法律保护制度,欧盟的数据库特殊权利保护制度是可以借鉴的立法例。
Information property theory meets with the needs of social practices and expands the existing intellectual property theory. It is a trend to adopt information property theory to database legal protection. Our state should set up a special right system in database legal protection which is suitable to our country, and can learn from the right legal protection system in database of European Union.
