摘要
近代社会是建立在契约的基础上的,因此理解近代以来的社会,契约是一个确定无疑的出发点。人类社会在工业化、城市化的过程中实现了“从身份到契约”的转变。在社会契约论的理论证明中,契约能够发挥秩序、平等、公正的功能。但在现实中,契约表现出了它的历史局限性,特别是在人们对平等的追求中,契约自身在逻辑上包含着被最终超越的可能性。
Contract is a doubtless jumping-off place for understanding modern society. Human society has already changed ＂from identity to contract＂ during the time of industrialization and urbanization. Society Contract Theory argues that contract can play the role of order, equality and equity. However, contract has shown its historical limit in reality, especially in the course of people going for equality, there is a possibility of contract being exceeded.
