研发创新中的知识产权与反垄断 被引量：5

摘要 有效的专利制度会为企业提供有效的创新激励,但是在高科技产业专利滥用行为会阻碍技术创新,因此反垄断法能够为技术创新扩散发挥有效的促进作用。中国在促进自主技术创新的过程中,需要将以专利法为核心的知识产权保护法律和反垄断法有机地结合起来,既为创新提供有效的激励,又防止跨国公司滥用专利权。
