摘要
文化、教育权利是公民基本权利。它们在权利属性方面存在着下列特点:文化、教育权利具有同质性;文化、教育权利是一种复合性的权利,既具有自由权的特点,又具有社会权的性质;文化、教育权利作为宪法权利决不仅仅是一种“指导规范”,而是可司法性的法律权利。
Cultural right and educational right are the fundamental rights of citizens that have features as follow： firstly, the cultural right and educational right have the nature of homogeneity; secondly, they are complex rights possessing the trait of liberty right as well as that of social right; thirdly, as the constitutional rights, Cultural right and educational right are not only instruction norms, but also justiciable legal rights.
