摘要
在建设新农村日益成为社会焦点的今天,农村和农民越来越得到了广泛的重视。在交错复杂的农村社会现象背后,农村环境和生态保护问题却常常在各种制度环境和政策背景下被遮蔽或淡化。农村环境问题已经触目惊心,数亿农村人口生存环境恶化,健康受到危害,且纠纷频发,成为社会一个非常不和谐的因素,成了建设和谐新农村的一大障碍。基于对现行环境法制度在农村的适用性的深思,本文用和谐社会的理念对现行农村环境法制进行了一番审视,并对农村环境法制建设提出了一些参考意见,期望对构建和谐新农村有所裨益。
While social spotlight is focusing on the construction of new rural areas, the rural areas are drawing more and more attention of the public and farmers are winning more and more respect from people. But behind the complex rural social phenomena, we discover that the problems of rural environment and ecological protection are frequently concealed or weakened under various excuses in the name of system or policy. The problem of the rural environment is soul-stirring. The deterioration of the survival environment of hundred millions of people in rural areas and the harm done to their health causing frequent disputes have become a very unharmonious factor as well as a major barrier in the construction of harmonious new rural areas, arousing our deep thought about the applicability of the existing environmental legal system in rural areas. The paper examines the existing rural environmental legal system in the concept of a harmonious society and proposes some opinions for reference in constructing the rural environment legal system, expecting to benefit the construction of harmonious rural areas.
