摘要
作为一种新型的行政模式,行政指导在实践中存在着指导失误、不当运用和违法运用的情形。由此产生的因行政误导而引起的纠纷,亟待从法律制度上加以规范并设置救济途径。研究信赖保护原则在行政误导中的适用,寻求保护信赖利益的有效途径,对保障公民的合法权益、维护政府诚信、促进行政指导的顺利实施、协调各方利益及构建和谐社会具有很重要的现实意义。
As a new administrative model, administrative guidance in practice suffers from misleading guidance, improper or even illegal application. Disputes incurred because of misguidance needed to be resolved and remedies reguired to be provided in legal manners. It is of great significance to protect of people＇s rights, maintaining the integrity of the government, promoting the smooth implementation of administrative guidance and coordination of different interests and building of a harmonious society and study the application of the principle of reliance protection in administrative misguidance and protect the interest of reliance.
