摘要
在建设和谐社会的时代背景下,警察行政指导对于实现"最大限度地增加和谐因素,最大限度地减少不和谐因素"的行政目标发挥着重要作用。由于警察行政指导还不是法律用语,学术上的地位也不够明晰,导致警察行政指导制度在理论和实践中还存在一些问题。为了把警察行政指导纳入法治的视野,应在警察行政指导中认真贯彻法律保留、法律优先、平等对待、比例、信赖保护等行政法基本原则,完善警察行政指导的程序和救济制度,以促进警察行政指导制度的良性发展。
The guide to police administration,which has an important function on the administrative objective to increase the harmonious factors and to reduce social conflicts under the background of setting up the harmonious society in China,and which is a wide range application in practice.There are some problems on the theory and practice of the guide to police administration now because of some reasons such as lacking clear academic position.Administrative law principles should be implemented into the guide to police administration,such as legal reservation principle,legal preferential principle,equal principle,proportion and trust protest principle,so on,to perfect the procedure and relief system and promote good progress of the guide to police administration.
