摘要
证据概念问题的大讨论使证据理论的研究更加深入,证据观念的大转变开创了证据学发展的新时代。实质证据观是正确的,应该在法学中予以确立,形式证据观应予以废除。证据是事实,证据只有两种属性,一为客观性,一为关联性。证据只有三种物证、书证和人证。三种证据理论可以穷尽所有证据。
The big debates about the conception of evidence have deepened the research of evidence theory. The big transformation of evidence idea starts a new era in the development of evidence theory. The view of essential evidence is right and it should be established in law. The view of formal evidence should be abolished. Evidence is a kind of fact, and it has two kinds of attribute： objectivity and conjunction. There are three types of evidence： material evidence, written evidence and witness. The theory of those types of evidence can limit all evidence.
