摘要
关于非法经营罪处罚的规定是依据情节轻重进行划分的,情节轻重主要是从经营数额、违法所得数额来判断的,这是不科学的。认定非法经营罪的数额标准应采取一种标准即非法经营数额,而且单位和自然人在成立非法经营罪的数额要求上应该统一。
The criterion for the punishment of illegal business is based on the serious result of the crime, which is chiefly determined according to the amount of money for illegal business and amount of profit obtained from it. In fact this is not scientific. The criterion to determine illegal business should be set based on the criterion, that is, the amount of money for illegal business. Furthermore, the unit and the person should be in consistent in the amount of money for the crime of illegal business.
