摘要
我们大力推行法制而在乡村社会屡屡受阻的情况下,我们更应该思考的不是法制的强制推行,而应对深刻的影响着中国人们的思维方式和行为方式的中国传统文化主脉的儒家伦理给予应有的关注,重新考量传统儒家伦理在当代中国法治建设中的影响。试从儒家伦理的内涵入手,探讨儒家伦理对当代法治的影响,思考如何实现传统文化中的有益资源与现代法治的融合。为我们建设社会主义和谐社会发挥积极作用。
Under the condition that we popularize legal system strongly in the rural with great difficulty all the time, what we should consider is not to popularize compulsively the legal system in the rural, but to pay attention to Corducianism ethics that have deeply affected the mode and thinking of Chinese people and the Chinese culture. And we must re-consider what a deep influence that Confucianism ethics bring about in contemporary legal system it is! This paper talks about the contents of the Confucianism ethics firstly; then it disfusses the great influence of Confucianism ethics on contemporary law; finally it tries to combine the beneficial resources of traditional culture and the modern law system to construct the harmonious social.
