摘要
目的有效地保护好中药的知识产权。方法比较与分析中药专利保护和中药品种保护这两种制度的差异,并提出利用这两种制度一些建议。结果这两种制度各有其优势与不足。结论应灵活运用好这两种制度,以便达到对中药知识产权的最佳保护。
Objective To protect the intellectual property of Chinese Medicine （ CM ） effectively. Methods The discrepancy of the patent protection system for CM and the kind protection system for CM were compared and analyzed, and some suggestions were provided in this paper. Results ＆ Conclusion Patent protection system for CM and the kind protection system for CM both have their advantages and disadvantages , so the intellectual property of CM should be protected effectively through taking advantage of these two systems ingeniously.
