摘要
目前中药和天然药物提取物的专利申请增长迅速,专利申请文件的撰写水平参差不齐,直接影响着最终获得的专利权保护范围,本文从专利的保护效力和专利审批要求方面分析了目前中药和天然药物提取物的专利申请的权利要求,指出专利有效保护中药和天然药物提取物要从选择适当申请时机,开发鉴别方法,合理清楚地撰写权利要求入手,提高专利对中药和天然药物提取物的保护水平。
The number of patent applications for extracts of Chinese natural medicines is increasing quickly. The scope of protection is directly affected by the quality of patent applications. In this article,the claims of patent applications for extracts of Chinese natural medicines are analyzed according to the validity of patent protection and requirements of Chinese patent law for patent application. Some suggestions provide the methods to effectively protect the patent of extracts of Chinese natural medicines, such as choosing rightly when to file the patent,developing the method to identify them,and writing reasonable scope of claims in order to improve the level of patent protection for them.
