On Legal Protection of Traditional Knowledge

摘要传统知识的法律保护问题越来越为国际社会特别是发展中国家所关注。从20世纪50年代至今,已有众多国际组织先后关注此问题,并试图给出解决方案,但结果却并不令人满意。我国学术界和立法界关注此问题的时间较短,基本是从20世纪90年代初开始,在近几年形成一个研究高潮。本文仅对传统知识保护的概况作粗浅的介绍。 The international society, especially developing countries show more and more concern for legal protection of traditional knowledge. Since 1950s, a lot of international organizations attempted to solve this problem. However the result was not satisfactory. The academic and legislative circles of China showed concern for it since 1990s and in recent years the study of this problem is reaching a climax. This paper gives a brief introduction to this phenomenon.
