摘要
新颁行的《中华人民共和国行政许可法》首次规定了信赖保护原则在行政许可中的运用。本文探讨了信赖保护原则的含义、渊源,分析了对被许可人信赖利益予以保护的缘由及适用条件,最后就我国《行政许可法》信赖保护原则不足之处提出了立法建议。
The principle of protecting the trusted profits is first affirmed in ＂Administrative Permission Law of People＇ s Republic of China＂ which is enacted not long ago. Knowing the meaning, sources, causes, conditions, applying qualifications and its limit for protecting the trusted profits of the permitted people is very important. And the perfection of protecting the trusted profits in administrative permission law will be propitious to carry out this principle in practice and consequently protect the trusted profits of the people who are permitted.
