摘要
阐述了理论界关于教唆他人自害行为三种不同的观点。分析了教唆他人自害行为不应以故意杀人、故意伤害罪或故意杀人、故意伤害罪的间接正犯论处,也不应以共同犯罪处罚。提出教唆他人自杀的,应以对教唆他人自杀罪论处。教唆他人自伤的,应以教唆他人自害罪论处。
This paper illustrates viewpoint of abetment for others＇ murders. There is great dispute in our criminal law. Now there are thee different viewpoints. Definitude regulation has made in our criminal law. But punishment shall be tried from character of abetment for others＇ murders. Trying to analyze and discuss in theory to the three different viewpoints in the text and expatiate auctorial viewpoint. This paper puts forward the necessity of set up the new accusal individually so that it can propel the improvement and perfecting of this issue in the criminal law.
