摘要
《中国—东盟全面经济合作框架协议争端解决机制协议》是落实《中国—东盟全面经济合作框架协议》的重要组成内容,对于中国和东盟全面的经济贸易合作将起到重要的推动和促进作用。该文件创设了富有自己特色的争端解决机制,为未来的中国—东盟自由贸易区提供必要的法律基础和保障,是自由贸易区赖以生存和发展的基本制度安排。
The＂Agreement on Dispute Settlement Mechanism of the Framework Agreement on Comprehensive Economic Co-operation between the People＇s Republic of China and the Association of Southeast Asian Nations＂ is a significant step towards the fulfillment of the ＂Framework Agreement on Comprehensive Economic Co-operation between the People＇s Republic of China and the Association of Southeast Asian Nations＂, greatly boosting and promoting the comprehensive economic and commercial cooperation between China and ASEAN countries. This document sets up a dispute settlement mechanism with its own characteristics and provides a necessary legal basis and guarantee for the forthcoming China-ASEAN Free Trade Area , thus constituting an indispensable systerm arrangement for the prosperity of that Area.
