摘要
物权法体现的是一个国家的经济制度、历史传统和人民的生活习惯。在物权法面临全球化的挑战中,物权法中的固有法内容,比如:关于所有权的类型的物权规范,关于用益物权类型的物权规范,与各国的习惯及现实经济生活密切联系的物权规范等等,是难以改变的,而其他如关于交易的规则、有关担保的规则、有关公示方法、效力等方面的规定等等都是可以国际化的。只有对此有清醒的认识,物权法才能真正面对全球化的挑战。
Law of property right is the embodiment of a country＇s economic system, historical traditions and people＇s living habit. When facing the challenges of globalization, the inherent part of the law of property right is hard to change, such as property right＇s regulation on ownership pattern, usufructuary right pattern and those links to the customs of every country and economic lives, while other aspects like regulations of trade, guarantee, publication and effects can be international. Only when we have a clear understanding of this can we face the challenges of globalization.
