摘要
法治政府的形成,离不开其预设(所谓预设即指事物的产生是以预先设立的理论为胚胎而发育)的理论基石。因此我们 在选择法治政府并建设法治政府的时候,有必要理清其预设的相关理论,以此作为我们的参照系。本文分析了法治政府的理论 预设的三个方面,即人性假设论、人民主权论,控权论,并指出其对于当前我国加强法治政府建设的启示。
Law-based goverment would not be achieved without the presupposition of theories involved. （Presupposition means that things are produced and developed on the basis of the presupposed theories.） Therefore presupposed theories involved need to be understood before we select and build a law-based government.This thesis is to analyse three aspects related to the proposed theories in question, i.e, the theory of human nature, the theory of people sovereignty and the theory of controlling power.
