摘要
城管制度屡遭诟病的原因除立法滞后、执法主体地位不明确、执法理念落后、执法人员素质参差不齐等主客因素外,还有城管机关的职权范围不明确这一重要因素。因而,笔者提出在执法权限上要授予其独立的调查权、适当的检查权和有限的强制权。同时要严格城管执法程序,加强对城管行使职权的监督。
The reasons for urban management system in addition to legislation have been repeatedly criticized for delay,the dominant position of law is not clear,the concept behind the law enforcement,uneven quality of law enforcement officers and other subjective and objective factors,there are terms of reference for urban management authorities of the important factors is not clear.Thus,the author proposes to grant the law enforcement powers on its independent investigative powers,proper inspection and limited the right to enforce rights.Urban management and enforcement procedures must be strictly the same time,strengthen urban management and supervision of the exercise of authority.
