摘要
机动车牌照授予行为属于行政许可的范畴。《道路交通安全法》第9条是对车辆牌照取得所作的一般性规定,即一般情况下机动车牌照不允许拍卖。但是当机动车牌照构成“有限公共资源”时,《行政许可法》第53条第1项即成为特别规定,应优先适用。而“有限公共资源”的判断标准,是“公共性”与“供需比例关系失衡”。因此当公共交通资源供不应求的情况下,通过拍卖的方式授予机动车牌照是合法的。
The act of issuing the license plate of motor vehicle by means of auction is within the scope of administrative license. According to the Law of the People＇ s Republic of China on Road Traffic Safety, the license plate of motor vehicle is not allowed to be issued by auction. When these license plates constitute the limited public resources, they should be governed by Administrative License Law. The criterion of limited public resource is publicness and unbalance between supply and demand. Therefore, under the circumstance of the demand of the public traffic resources exceeding supply, it is legitimate to issue the license plate of motor vehicle by auction.
