摘要
围绕我国《宪法》、《民法通则》、《中华人民共和国农业法》、《土地管理法》、《中华人民共和国农村土地承包法》、《担保法》及行政法规、规章和地方性法规、国家政策及相关的司法解释中有关我国土地承包经营权规定,对我国现行的农村土地承包经营权制度的缺陷进行深入分析和论证。
Based on Chinese “Constitution”, “ General Principles of Civil Law”, “ Law on Agriculture”, “Law on Land Administration”,“ Law on Rural Farmland Contract ”, “ Law on Security” and the regulations of administration and districts, and the national policy and rules of the operating right of the contracted farmland in the relevant judicial interpretations, a further analysis and argumentation are made in the present legislation situation and defects in the system of the operating right of the contracted farmland in rural China.
