摘要
我国已经进行了许多水环境管理的立法,这些立法在我国的水环境管理中发挥了重要的作用;然而,我国的水环境管理立法也存在许多问题,包括缺乏完整的跨行政区水环境管理的政策、法规体系不健全、管理制度不完善、管理体制不能适应实际管理的需要和对法律的执行缺乏公众监督机制等。解决这些问题,需要改变目前的一些立法原则和制度安排。主要包括:制定全面系统的跨行政区水环境管理的政策;健全跨行政区水环境管理的法律、法规体系;完善跨行政区水环境管理制度;理顺跨行政区的水环境管理体制;建立完善的公众参与机制;转变观念,与时俱进,建立一个真正的良治社会。
China has enacted a lot of legislations to manage her water environment, which have taken great effect indeed. However, some defects still exist in the legislations. To illustrate, no good policy is adopted to manage trans-administrative-area water environments ; a relevant statutory framework needs to be improved ; management is defective ; the administrative structure cannot meet the practical demand; law enforcement is not under supervision of the public; etc. The resolution lies in furthering the current legislative principles and improving the legal system, which includes： to adopt a uniform and systematic policy of trans-administrative-area water environment management; to improve the relevant statutory framework and administrative systems and harmonize all concerned administrative agencies; and to establish a well-adjusted mechanism of public participation. In this author＇s opinion, we should change our concepts, keep pace with the forward era and set up a society of good governance.
