摘要
为当代法治文明发展所日益普遍认可的死刑制度存置的不合理性,值得我们重新审视这一亘古以来为民众和历代统治者所关注的“严刑峻罚”。作为犯罪的最严厉惩罚和进行阶级统治的工具,死刑并非实现报应正义的必不可少的手段。中国死刑制度发展的合理方向———应废除死刑。但这需要创造必要的物质文明条件和精神文明条件。
The irrationality of the setting of death penalty has been increasingly proved by the development of contemporary legal civilization, having us to restudy“the severe penahy”on which the close attention has been paid by the people and the rulers from the very beginning it was set. As the harshest punishment of crimes and the tool of ruling, death penalty is not the essential approach to the revenging justice. In China, the orientation of the development of it is to abolish it with the condition that the necessary material and spiritual civilization are well created.
