摘要对我国体育行业协会产生的社会背景和理论背景进行探讨,对其法律性质、分类及自治权进行研究,明确我国体育行业协会的法律渊源;运用经济法理论重点对体育行业协会自治权进行分析,行业协会具备发起成立权、规章制定权、监督管理权、惩治处罚权、争端解决权、诉讼权等,这些权限使行业协会自治得到进一步规范。 In order to promote our sports business development, this paper made discussion on social and theoretical background of sports trade association. The result showed that the system of sports trade associate met the requirement of social economic and sports development. It studied the nature of law ,category ,origin and content of its autonomy in order to make clear its legal origin. Through using some key points of economic law to analyzes the content of autonomy of sports trade associate including initiating and establishing right, regulation making right,supervising and managing right,punishing right,dispute-settling right,lawsuit right so as to further normalize its trade administrating conducts.
