摘要
公民社会是一个原本由西方学者提出、用来研究西方社会的理论,同时也是具有不同意义和多种规范性词义的理论概念。我们可以对公民社会的理论和概念作结合中国社会实际的选择和发展。在此,公民社会是指包含了由个人、民间团体之间的自愿安排来组织的若干社会生活领域的政治共同体。我们可以从规范性的角度概括出它的若干特点;在中国存在着中国公民社会形成的动因;从描述性的角度,中国公民社会开始萌发。同时,它也面临着一些困难,法治是解决这些困难的一个重要方法。
Civil society theory with its diverse meanings and normative conceptions is a theory first used by Western scholars to study Western society. Chinese exports can choose from those different conceptions and develop a theory applicable to the Chinese social condition. The civil society theory in China refers to a political community of private citizens and voluntarily organized groups that are active in certain social areas. One observes some normative features and motivations for the formation of the Chinese civil society. The civil society, nevertheless, faces challenges, and the rule of law will play an important role in the development of the Chinese civil society.
