摘要
我国环保法实施中存在一些具体问题:有关规定过于粗疏,弹性过大,执法手段软等。在此基础上,提出了几点建议:建立良好的环保法实施机制;实施垂直管理;强化环保部门的执法权力,提高执法能力;加强环保执法力度,规范环境执法行为;改进目前的环境执法与司法方式,逐步实现环境法治;提高公众环境意识,建立和完善环境保护的公众参与机制。
There are a few problems in the enforcement of “Envi ronmental Protection Laws” in our country.Some prescriptions in the law are too sketchy,too flexible and the administration of the law is not rigid and etc.On basis of the above-mentioned,six pieces of suggestion are brought up:establishi ng an excellent system for the enforcement of “Environmental Protection Laws” ; adopting vertical management; intensifying the power of environmental protect ion and raising their ability to administrate laws; implementing the environment al laws more firmly and standardizing the behaviour in execution of the laws; en hancing the exectative and judicical approches at present;makeing it available t o maintain environment according to the laws concerned; enhancing the public’s sense of protecting environment; establishing system which makes the public part icipate in the environmental protection actively and widely and perfecting the s ystem step by step.
