摘要
《劳动法》既有相对稳定性,但随着社会的发展也会有所变化发展。而且《劳动法》本身也有争议的地方。主要针对劳动者的辞职自由———单方解除劳动合同权展开论述。首先分析了关于此项自由规定的第31条的立法理论基础,然后着重解析理论界与实践中适用第31条的问题与缺陷,并在此基础上提出了劳动法第31条的完善建议。
Labour Law is comparatively stable, but it will change with the development of society. Sometimes the Labour Law itself has some controversial points. This article focused on the freedom of labour's resignation——single dissolving the rights. Firstly, analysis the base of legislation of item 31, then focused on the problems and deficience of Item 31 and put forward the complete suggestion of Item 31.
