摘要
法官自由裁量权是法官在司法过程中享有的正当权力 ,司法公正的实现离不开法官自由裁量权的恰当行使。文章从自由裁量权的含义入手 ,探讨了自由裁量权的一般价值 ,特别对于司法公正的实现所产生的积极作用 ,并就如何保障这一权力的恰当行使提出了几点建议。
Discretion is the legitimate power which is enjoyed by the judge during the course of judicature.That it being performed properly is indispensable for fair judicature.In this article,the author takes the implication of discretion as the point of departure and looks into the value of discretion,especially its spurring the progress of fair judicature.Besides,the author proposes some suggestions on how to limit the discretion of a judge in order to ensure the power performed properly.
