摘要
对虚假广告的界定是认定虚假广告罪的关键。现实生活中的虚假广告多从静态意义理解 ,刑法中的虚假广告则侧重指发布虚假广告的行为 ,要求必须具备主客观两方面要件。根据行为人的目的和广告内容不同 ,具体分为三类 ,但并非一律以虚假广告罪定性处理。
The definition of the false advertisement is the crux of identifying this type of offence. In daily life, the offence is understood in the static sense. In criminal law, it lays particular emphasis on the behavior of issuing the advertisement, and requires the elements of the objective and the subjective. It can be classified in 3 types according to the content and the aim of the offender, while the 3 types are not all associated with the offence of false advertising.
