摘要
虚假广告在现实生活中大量存在,但是虚假广告罪在司法实践中运用极少,究其原因,是虚假广告罪中"虚假广告"界定不清,虚假广告罪侵犯的客体认识错误以及虚假广告罪的行为犯属性被忽略。"虚假广告"是指对商品或服务的主要内容作不真实的或引人误解的表示,导致或足以导致消费者对其产生高期望值,从而做出错误判断的广告;虚假广告罪侵犯的法益是正常的市场交易秩序,其行为性质是行为犯。基于此才能准确界定大量存在的虚假广告行为是否构成虚假广告罪,并准确地对行为人施以刑罚。
A large number of false advertising behaviors have been in real life,but the crime of fraud is seldom implemented in judicial practice.The main reason is the inaccuracy of definition of false advertising,understanding error of object and the nature of behavioral offence.False advertising means false or misleading introduction about goods and service that cause consumers to produce high expectation to take a wrong judgment;the object of crime of fraud is normal transaction order;its nature is behavioral offence.Based on this,we can accurately define that the behavior is a crime or not and punish producers precisely.
