摘要
本文应用我国民法中确定民事责任的若干原则,参照英美普通法和其他国家法律的有关规定,对海上货物运输合同中船舶所有人或承运人提供适航船舶义务存在的若干法律问题进行了探讨,并力图提出适合我国国情的一些原则和观点,供我国海运司法界参考。
Ln the light of some of the principles for establishing civil liability under the Chinese well law and in reference to the Anglo-American common law as well as the prelevant statutes of some other juristictions,this paper,aiming at advancing principles appropriate to the present situations in China, approaches some of the perlexing legal issues existing in the obligation of shipowners or carriers to make ships seaworthy.
