摘要
农村集体土地承包经营权证书发放为初始形式的农村土地登记制度引入 ,提高了国家对农民合法土地权利的保护力度。农村土地承包经营权登记或发证在使农民获得完整的合法土地产权、增强农民对土地权益的了解与信心、对抗农村集体干预、降低土地交易成本等方面创造了有利于农村土地市场流转的条件。江苏南通的统计数据表明 ,在农村土地承包经营权发证率较高的地区 ,农村土地承包经营权流转市场越发达 ,农户对农村土地产权稳定性信心越高 ,农村土地交易费用越低。因而有必要按照规范土地登记制度的要求 ,继续推进农村土地登记制度建设 ,以彻底实现农村土地制度改革。
Since the rural reform of family responsibility system of 1978 in China mainland, the state persisted in assigning safer and stable farm land property rights to rural families to encourage free transaction of farm land use rights which favored effective and sustainable land use. For the efforts of rural collectives, objectives of the state was not fulfilled ideally. Therefore contracted land registration system was introduced to complete the redistribution of farm land property rights more directly. Registration of contracted land rights would boost farm families entrance into land market theoretically through protection of families legal farm rights, restriction of rural collectives interference and cutting down transaction costs. Statistic from Nantong municipality proves that farm land transaction is more prevalence where more rural families receive certificate of contracted land rights.
