摘要
法律移植以理解为前提 ,理解是视域的融合 ;但中国传统文化的视域难与近代以来西方法律制度的视域融合 ,因为二者有着实质性差异 ;解决这一问题的方法是在中国培植近代以来西方法律制度所需要的文化生态环境———商业社会。
The transplantation of laws should be based on und erstanding whereas understanding refers to the fusion of horizons. However, due to the substantive differences between the horizons of western law systems and C hinese traditional culture, it is difficult to fuse them together. The method to deal with this is to cultivate a commercial society in China——the cultural ec ological environment needed by western law systems.
