摘要
法的精神支配着对社会经济、政治、文化进行的法律性制度安排,法的精神是一种存在于所有法律当中的价值观念,它来源于对正义的不断追求。渊源于古希腊哲学的正义观是西方法律制度内在的根本观念,它启示和支配着根植于西方文明的法律制度的产生和发展。每一时代的正义观念都从社会观念的角度引导着法的发展,制约着法的发展,体现在法的制度之中,成为法发展变化的灵魂和精神。
The spirit of law is the values of law included by all the legal systems, and it stems from the constant pursuit of justice. Justice is a kind of virtue produced in social relationships, but the law is the embodiment of the justice. The basic goal of legislation is promoting the realization of justice. The justice view springing from ancient Greek philosophy is the inherent basic idea of the western legal system, and it enlightens and arranges formulation and development of the legal system implanted in western civilization. The justice view of every era reflects in the system of the law. It leads to and restricts the development of the law in terms of social idea, and it becomes soul and spirit of law development and change.
