摘要
遵守 TBT协议 ,合理运用 TBT协议的相关规则 ,建立我国的技术法规体系 ,是加入 WTO后我国经济发展之需要 ,而建立科学的技术法规体系就需要具有科学的技术法规基本理论作为法理依据。
This essay first defines the meaning of technical regulation under the WTO mechanism, studies the difference between technical regulation and technical criterion, technical regulation and oblige criterion;then studies it s legal essence, draws a conclusion that technical regulation belongs to the economic law; Finally discusses the legal significance of technical regulations according to the efficiency theory and justice theory.
