摘要
行政规章在现代法律体系中占有重要地位， 其产生和存在是社会众多因素综合作用的结果。但是， 行政规章的低效益性要求我们革新传统的行政立法观念。行政规章对社会生产生活的干预应在必要的法律事项和限度内， 其可行性和效果要经受法律经济分析方法的检测， 应科学处理行政立法程序中决策成本和外在成本的相互关系。行政规章丛生以及其逻辑结构中权利与义务的非均衡配置， 是立法寻租的表现，
Administrative regulations play an important role in the modern legal system, and owe their origin and existence to the interaction of many different social factors. The inefficiency of administrative regulations, however, forces us to seek reform of the traditional thinking on administrative legislation. Administrative regulations have to function in society within the limit of law. Their feasibility and effect must stand the test of economic analysis in law. The interaction between internal cost and external cost in the procedure of administrative legislation must thus be dealt with in a scientific way. The imbalanced match between right and responsibility in the logic structure of administrative rules requires action. The public interests of administrative rules must be emphasized in conformity with the purpose of legalization as well as the form of the system.
