摘要
平等受教育权体现的是一种平等权,是针对国家教育资源有限情况下所确定的一项权利。其是国际法公认的基本人权内容,也是各国宪法法律保障的基本权利。我国公民平等受教育权的目标还远远没有实现,特别是当前,由于历史和现实的原因,不平等现象仍十分突出,种种教育制度的弊端以及歧视性规定已经成为平等受教育权实现的严重障碍,本文通过对公民平等受教育权的现实状况的梳理,提出逐步实现平等受教育权的建议。
What equal right to education reflects is an equal right which is defined under the circumstance of limited national education resources.It embodies the fundamental human right recognized by international laws and it is the fundamental right guaranteed by the Constitutions and laws of the countries around the world.In China,the goal of citizen equal right to education is far from realization.In particular,due to the historical and realistic reasons,the phenomenon of inequality is still obvious.Various disadvantages and discriminatory regulations have become the serious hinders for the realization of equal education right.This paper puts forward suggestions on how to realize equal right to education gradually through cleaning up the current situation of citizen equal right to education.
