摘要
我国现行广告立法没有规范广告表演者对瑕疵广告的法律责任。本文阐释了广告表演者的概念与特征;坚持瑕疵广告的表演者应当承担法律责任,且不以造成消费者实际经济损失为成立要件。
There is no regulation about the legal responsibilities that advertisement performers should take for dishonest advertisements in the “Advertisement Law' currently in China. In this paper the author elaborates the definition and features of an advertisement performer and puts forward the idea that advertisement performers should take legal responsibility for their dishonest advertisement.
