摘要
建立和完善案例指导制度,是完善我国社会主义法治的需要。我国悠久的判例法传统,以及近年来各级人民法院的探索实践,已为我国建立案例指导制度准备了条件。下一步,应尽快出台相关规范性文件,对指导性案例的发布主体、效力定位、编选标准、制作格式和援引方法等予以规范,以促进司法公正和司法统一。
