摘要
尽管中国融资租赁业的规模正在不断扩大,市场运行环境和内部运行机制已经得到很大程度的改善,但是,仍然存在着很多制约融资租赁业进一步快速发展的因素,其重要因素是中国尚缺乏完备的融资租赁法律的支持。为促进我国融资租赁业的发展,我国应借鉴《国际融资租赁公约》及发达国家的立法经验,尽快制定专门的融资租赁法,以对融资租赁合同的生效,出卖人违约时出租人和承租人的救济权利,租赁物质量瑕疵担保责任,承租人对出卖人的请求权,承租人违约的违约救济,租赁物使用对第三人的侵权责任等法律问题的解决予以立法完善。
Though the size of Chinese finance lease trade is constantly enlarging and market environment and its internal systems have got improved to a large extent, many factors that restrict finance lease trade to develop more fleetly still exist, the important one of which is that China still lacks the support of selfcontained finance lease law system. In accelerating the development of Chinese finance lease trade, China should use International Finance Lease Convention and developed countries' legislation experiences for reference in constituting a special finance lease law as quickly as possible so as to settle the problems of finance lease contract, of the lessor's and the lessee's succor right when the seller breaks the contract, of the surety of the lease's quality spots, of the lessee's request right to the seller ,of the breach of contract succor of the lessee's default of the tortuous liability to the third party for using leases, and so on.
