摘要
欧盟拥有较为成熟和完善的竞争政策体系,在规范数字经济方面一直走在世界前列。数字经济新业态、新模式的迅速崛起对现有竞争秩序形成挑战,传统反垄断分析框架逐渐难以适用,素有市场经济"经济宪法"之称的竞争政策亟须做出调整。欧盟竞争政策当前面临对数字经济反垄断行为认定和识别困难、监管和竞争执法难度加大等挑战。为充分保护竞争,欧盟从健全数字竞争规则、创新平台竞争监管方式、更多赋权给成员国竞争执法机构、加强反垄断国际交流与合作等方面应对数字经济下的竞争监管挑战,为我国数字经济下竞争政策的发展提供了有益借鉴和启示。参考欧盟应对数字经济的监管经验,我国应从健全反垄断制度规则、明确执法机构权责、创新反垄断执法手段、强化反垄断执法的跨国监管与合作等方面来不断强化数字经济下的竞争监管。
The EU has a relatively mature and perfect competition policy system and has always been in the forefront of the world in regulating the digital economy.The rapid rise of new formats and models of digital economy challenges the existing competition order.The traditional antitrust analysis framework is gradually difficult to apply.The competition policy known as the"economic constitution"of market economy urgently needs to be adjusted.EU competition policy is facing challenges such as hard to maintain and identify antitrust acts and increasing difficulties in supervision and competition law enforcement in the digital economy.In order to fully protect competition,the EU addresses the challenges from the aspects of improving digital competition rules,innovating platform regulation methods,empowering more to competition authorities of Member States,and strengthening international anti-monopoly exchanges and cooperation which provides a useful reference and inspiration for the development of China’s competition policy under digital economy.Referring to the EU’s regulatory experience,China should strengthen the competition supervision from the aspects of improving the rules of antitrust system,clarifying the power and responsibility of law enforcement agency,innovating the means of anti-monopoly law enforcement,and strengthening transnational supervision and cooperation under the digital economy.
