摘要
党的二十大报告指出,“形成同我国综合国力和国际地位相匹配的国际话语权”,然而,我国在以WTO为代表的国际贸易法制中的话语权与要求尚有很大差距。中国作为一个新兴的大国,对于当前国际贸易法制不稳定性状态,需要深刻了解作为国际公共产品的国际贸易法制的形成机理,有责任去维护我国所坚持的符合全球最大利益的多边贸易体制;同时在维持现有多边贸易成果前提下尽量包容现在的国际贸易法制,秉持构建人类命运共同体理念和共商共建共享合作共赢的主导价值观,参与多边贸易法制的变革。与此同时,按照一国在国际贸易法制形成中主导话语权成因即实力反映、能力决定和市场依赖,针对我国在WTO中话语权不足的原因,建议统筹实力、能力和市场依赖三者扩大中国在国际贸易法制中的话语权。
The report of the 20th National Congress of the Communist Party of China requires“to form an international discourse that matches China’s comprehensive national strength and international status”.However,there is still a significant gap in China’s discourse in the international trade legal system represented by the WTO.As a rising power,China needs to deeply explore the formation of the international trade legal system as international public goods,and help maintain the current multilateral trading system.At the same time,on the premise of maintaining the existing multilateral trade achievements,we should try our best to accommodate the current international trade legal system,uphold the concept of building a community with a shared future for mankind and the leading value of extensive consultation,joint contribution,shared benefit,win-win cooperation in view of the current instability of the international trade legal system,and participate in the reform of the multilateral trade legal system.Meanwhile,according to the causes of the dominant discourse power of a country in the formation of the legal system of international trade,namely the strength reflection,capacity and market dependence,aiming at the reasons of the insufficient discourse power of our country in the WTO,it is suggested that China take into account the strength,capacity and market dependence as a whole to amplify its discourse power in the legal system of international trade.
