The initiative to ban destructive direct-ascent anti-satellite(ASAT)missile testing,spearheaded by the U.S.and subsequently adopted by the UN General Assembly,represents a pivotal yet limited step in addressing the mi...The initiative to ban destructive direct-ascent anti-satellite(ASAT)missile testing,spearheaded by the U.S.and subsequently adopted by the UN General Assembly,represents a pivotal yet limited step in addressing the militarization of outer space.Tracing the historical evolution of ASAT technology since the Cold War,this paper examines the divergent state practices of major spacefaring nations-including the U.S.,Russia,and India-highlighting their technological advancements and geopolitical motivations.Through an analysis of existing treaties,recent resolutions,and the persistent divide between western states and the China-Russia bloc over the Prevention of an Arms Race in Outer Space(PAROS),the study underscores the initiative’s inherent limitations in deterring comprehensive militarization.The paper concludes that sustainable space safety necessitates multilateral,legally binding agreements that transcend symbolic measures,should reconcile competing state interests.Achieving this requires global cooperation,compromise among major powers,and a reinvigorated commitment to the peaceful use of outer space enshrined in international law.展开更多
The accumulation of space debris is becoming a growing concern due to the deliberate destruction of satellites using DA ASAT weapons.This poses a significant threat to outer space's long-term sustainability.The co...The accumulation of space debris is becoming a growing concern due to the deliberate destruction of satellites using DA ASAT weapons.This poses a significant threat to outer space's long-term sustainability.The congestion of orbital space caused by space debris increases the risk of collision of space objects,endangering their functionality and posing hazards to the space environment and human existence in space and on Earth.Additionally,collisions can trigger Kessler syndrome,which could jeopardise future space activities and risk space sustainability.Addressing these challenges requires collaborative international efforts,including the development of a global,legally binding framework,the establishment of a concentrated internationally recognized space-debris regulation organization,discouraging the conduct of DA ASAT tests,limiting the generation of space debris,implementing space-debris tracking and mitigation strategies,and attributing ownership of space debris and liability for damage caused.This paper critically examines the challenges posed by the generation of space debris resulting from the DA ASAT test and the effectiveness of the current international legal framework in addressing the issue.Additionally,the paper highlights the shortcomings in the current global legal framework and recommends enhancements to address the present challenges.展开更多
