There is a wide recognition that encompassing an obligation of good faith in every commercial contract is one of the most important advances in contract law in the twentieth century^([1]).Despite the fact that this co...There is a wide recognition that encompassing an obligation of good faith in every commercial contract is one of the most important advances in contract law in the twentieth century^([1]).Despite the fact that this concept has been incorporated in the vast majority of national legal systems,its precise scope and application may vary from one to another,depending on the commercial traditions and customs of each legal system^([2]).The fact that good faith has been treated differently in different national legal systems has also been reflected on the international level through its inclusion in international legal instruments,one of which is the United Nations Convention on Contracts for the International Sale of Goods(hereafter CISG).In this article,the legislative history of the CISG will be closely examined with the purpose of finding out how a compromise was reached between the common law countries,which expressly objected to the imposition of a duty of good faith,and the civil law countries,which explicitly endorse its incorporation.A logical result flowing from this historical examination,as will be submitted,is that the conceptual ambiguity of good faith is the underlying reasoning behind their fundamentally different attitudes towards the incorporation of this notion in the international commercial context.展开更多

The governance of algorithms is a central issue in the progress on the rule of law in an intelligent society.In the field of copyright law,the allocation of infringement liability for algorithmic recommendation servic...The governance of algorithms is a central issue in the progress on the rule of law in an intelligent society.In the field of copyright law,the allocation of infringement liability for algorithmic recommendation service providers should proceed from a systemic perspective rooted in the rule of law spirit of the times.Moving beyond the principle of technological neutrality and toward the principle of digital for good,it requires exploring the key role of online platforms in preventing infringement and fostering the development of digital technologies for good.This calls for the establishment of a legal system that is conducive to the combination of law and technology to support multi-stakeholder co-governance.It is recognized that algorithmic recommendation service providers bear a higher duty of care under specific conditions than that imposed by the noticeand-takedown process.The determination of whether such providers have fulfilled their duty of care should be based on industry-specific technological advancements,taking into account multiple factors such as the infringement damages,the probability of infringement occurrence,the cost of preventing infringement,and the copyright protection measures already taken in their algorithmic recommendation systems.At the same time,mechanisms such as effective notification,an efficient appeal process,and the right to request content restoration should be established to effectively protect the users'interests.展开更多

Existing weapon-target assignment methods primarily focus on macro cluster constraints while neglecting individual strategy updates. This paper proposes a novel weapon-target assignment method for UAVs based on the multi-strategy threshold public goods game(PGG). By analyzing the concept mapping between weapon-target assignment for UAVs and multi-strategy threshold PGG, a weapon-target assignment model for UAVs based on the multi-strategy threshold PGG is established, which is adaptively complemented by the diverse cooperation-defection strategy library and the utility function based on the threshold mechanism. Additionally, a multi-chain Markov is formulated to quantitatively describe the stochastic evolutionary dynamics, whose evolutionary stable distribution is theoretically derived through the development of a strategy update rule based on preference-based aspiration dynamic. Numerical simulation results validate the feasibility and effectiveness of the proposed method, and the impacts of selection intensity, preference degree and threshold on the evolutionary stable distribution are analyzed. Comparative simulations show that the proposed method outperforms GWO, DE, and NSGA-II, achieving 17.18% higher expected utility than NSGA-II and reducing evolutionary stable times by 25% in large-scale scenario.展开更多

Inkjet 3D printing has potential in the additive manufacturing of electronic circuits and devices.However,inks that can be used for printing layers with T5%>300℃ or hardness>200 MPa have been rarely reported.Cy...Inkjet 3D printing has potential in the additive manufacturing of electronic circuits and devices.However,inks that can be used for printing layers with T5%>300℃ or hardness>200 MPa have been rarely reported.Cyanate ester(CE)polymers have excellent thermal stability,high strength,and low shrinkage compared to other common dielectric inks for inkjet 3D printing,but cannot be quickly shaped by ultraviolet(UV)irradiation or thermal treatment.Combining CEs with UV-curable monomers may be a possible way to accelerate crosslinking,but there are challenges from the adverse effects of the dilution of both monomers.In this study,dielectric inks with acrylate and cyanate moieties were developed.The low viscosity and surface tension of the CE precursor(Bisphenol E cyanate ester)were combined with photocurable acrylate diluent monomers and cross-linker to realize an ink suitable for inkjet 3D printing.An internal dual three-dimensional cross-linked network structure resin was prepared by a combination of photocuring and thermal curing with T5%up to 326.69℃,hardness up to 431.84 MPa,dielectric constant of 2.70 at 8 GHz,and shrinkage of 1.64%.The developed dielectric inks can be applied to the 3D printing of printed circuit boards and other electronic devices that require dielectric properties.展开更多

文摘Since the Harris-Todaro model was proposed in 1970,it has played a crucial role in analyzing various environmental and trade issues in developing countries.This paper analyzes the effects of the amount of public intermediate goods provided by the government,the increase in the fixed wage rate in the urban sector,and the changes in the relative international prices of agricultural and manufacturing goods on labor employment,unemployment,and the economic welfare in the context of a small open economy.It also proposes relevant policies to reduce the unemployment rate while improving national welfare.
